These Terms govern your use of MailOutly (the “Service”). By creating an account or using the Service, you agree to these Terms.
1. The Service
MailOutly provides tools to generate email templates, manage leads, and send email campaigns using your connected email account. You are responsible for the content you send and for compliance with all applicable laws and provider policies.
2. Eligibility & Accounts
- You must provide accurate information and keep your account secure.
- You are responsible for activity on your account.
- We may suspend accounts involved in abuse, spam, fraud, or policy violations.
3. Acceptable Use
You agree not to use the Service to:
- Send unlawful, deceptive, or abusive communications.
- Send spam or unsolicited email in violation of CAN-SPAM, CASL, GDPR, or similar rules.
- Harvest addresses, scrape data unlawfully, or violate third‑party rights.
- Disrupt or compromise the security of the Service.
4. Third‑Party Services (Gmail / Google)
If you connect Gmail, you authorize us to use OAuth tokens to send emails on your behalf. Your use is also subject to Google’s terms and policies. We may revoke or limit functionality if required by Google or if misuse is detected.
5. Subscriptions, Billing & Changes
- Paid plans renew as described at purchase unless canceled.
- Plan limits (such as daily send limits) may vary by plan and can change over time.
- We may update pricing and features; changes apply prospectively.
6. Refunds

7. Intellectual Property
The Service, branding, and software are owned by MailOutly and protected by applicable intellectual property laws. You may not copy, modify, or resell the Service except as permitted by law.
8. Disclaimer
The Service is provided “as is” and “as available”. We do not guarantee deliverability outcomes, reply rates, or specific business results.
9. Limitation of Liability
To the fullest extent permitted by law, MailOutly will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access if we believe you violated these Terms or created risk.
